Model Release
The model release is a legal form signed by the model or models that appear in a particular photograph. In this release, the individual featured in the image gives permission for their likeness to be used for various commercial purposes such as advertising and promotional materials, web page design, broadcast exhibitions, and various publications.
The Site Member is required to have this model release on file for all applicable images. When an image is added to the database, the Site Member must indicate either the existence of a model release, that a model release does not exist, or that a model release is not needed. Model Release and Sensitive Subjects
Per the Wishstock Site Use and License Agreement, the general Model Release does not cover use of the image in any manner that involves a sensitive subject or pornography, or in any defamatory manner toward the person or persons in the image.
There is one exception. If the way in which an image is used depicts sensitive issues that present a model negatively or implies the use or endorsement of a questionable product or service by that model, it will still be acceptable for use provided that content also indicates the person depicted is a model and used only for illustrative purposes. Any licensee unsure if an intended use could be deemed a sensitive subject area is asked to please contact Wishstock for clarification.
Requesting a Model Release
The Site Member is required to obtain and keep on file all original model releases for applicable images. In the event that the licensee needs a copy of the release for legal reasons, Wishstock requires that the Site Member fax to the licensee a scan of the original release signed by the model or the model's guardian in the case of a minor. For privacy, the Site Member needs to black out any sensitive details on the a requested model release. Sample Model Release (pdf)
